These Terms of Service (“Terms”) govern your access to and use of PhraseBoost's website, mobile applications, and related services (the “Services”). By using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
The Services
PhraseBoost provides language-learning tools and content focused on useful phrases and conversation practice. Features may change during pre-release testing. We may add, modify, or remove functionality at any time.
Accounts
Some features may require an account. You agree to provide accurate information and to keep your credentials confidential. You are responsible for activity under your account. Notify us at hello@phraseboost.com if you suspect unauthorized access.
Acceptable use
You agree not to misuse the Services. For example, you must not: break the law; attempt to gain unauthorized access to our systems or other users' data; interfere with the Services; scrape or harvest data in bulk without permission; reverse engineer except as allowed by law; or use the Services to build a competing product using our proprietary materials.
Intellectual property
The Services, including software, text, graphics, logos, and lesson content, are owned by PhraseBoost or our licensors and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable license to use the Services for your own learning, in line with these Terms. No other rights are granted.
Third-party services
The Services may link to or integrate with third-party sites or stores (for example, Google Play). Those third parties have their own terms and privacy policies; we are not responsible for their practices.
Disclaimers
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation, or that content will meet your goals.
Limitation of liability
To the fullest extent permitted by law, PhraseBoost and its affiliates, directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising from your use of the Services. Our total liability for any claim arising out of these Terms or the Services is limited to the greater of fifty U.S. dollars (USD $50) or the amount you paid us for the Services in the twelve months before the claim (if any).
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum permitted by law.
Indemnity
You will defend and indemnify PhraseBoost against any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your misuse of the Services or violation of these Terms, except to the extent caused by our willful misconduct.
Suspension and termination
We may suspend or terminate your access to the Services if you violate these Terms or if we need to do so for legal, security, or operational reasons. You may stop using the Services at any time.
Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. Courts in Delaware have exclusive jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction.
Changes
We may update these Terms from time to time. We will post the updated Terms on this page and change the “Last updated” date. If a change is material, we will provide reasonable notice when practical (for example, by email or in-app). Continued use after the effective date constitutes acceptance of the updated Terms.
